3. Software "As Is" & Limitation of Liability
All software, APIs, tools, and applications provided on this domain and its subdomains are provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Under no circumstances shall Soham Chakraborty be held liable for any direct, indirect, incidental, or consequential damages—including loss of data, revenue, or business—arising from bugs, downtime, or the use of my experimental software.
4. Freelance Services
Inquiries made through the contact form do not constitute a binding legal contract. Formal freelance engagements will be governed by a separate, dedicated Statement of Work (SOW) mutually signed before work commences.
5. Third-Party Services & Hacking Indemnification
My applications and freelance projects frequently integrate verified third-party infrastructure (such as standard Auth providers, Cloud databases, and Payment Gateways) to handle secure transactions and data routing. I hold zero liability for any outages, errors, or policy changes enacted by these third parties. Furthermore, while I enforce strict security protocols, no system is entirely impenetrable. In the highly unlikely event of a cyberattack, malicious hacking, or data breach affecting madebysoham.com, you agree to fully indemnify and hold me harmless from any resulting legal or financial claims.
6. Digital Store & Usage Licensing
For any premium code, templates, or SaaS boilerplates purchased from the internal Digital Store, you are granted a non-exclusive license for internal business deployment and product building. Under no circumstances may you repackage, open-source, or resell the raw foundational source code or UI templates as a standalone competing product or repository.
7. Acceptable Use & Account Termination
By interacting with my APIs, SaaS platforms, or LLM environments, you agree not to engage in reverse-engineering, malicious DDoS load testing, automated scraping, or illegal activities. I reserve the absolute right to throttle IP addresses, revoke API keys, or permanently terminate accounts without a refund if abusive or harmful usage is detected.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
9. Payments and Refunds
For freelance deliverables, premium application tiers, and digital products, payments may be collected via supported processors (such as Razorpay), UPI, or direct bank transfer. Given the true digital nature of the software and services provided, all sales are considered final once the code or product is delivered. Refunds for freemium tiers, in-app purchases, API top-ups, or freelance retainers are evaluated on a strict case-by-case basis at my sole discretion.
